In view of the U.S.A. Government approved legislation referred to as the International Marriage Broker Regulation Act of 2005 (IMBRA), HEAVENLY HEARTS is offering New Members who currently reside in U.S.A. the choice of either Regular Membership or IMBRA Compliant Membership.

Preamble

As the accepted ideologies of personal freedom and privacy can sometimes be challenged and often road-killed by governments and their legacy of authoritarian legislation, so too can the after-effects of a Governing Administration's political agenda have an impact that is so widespread that it not only threatens said ideologies, but also disrupts the general status quo. The International Marriage Broker Regulation Act of 2005 (known under the abbreviation of IMBRA) is one such legacy of the Bush Administration (U.S.A.) and many believe it's one that works against, rather than for, the betterment of an individual and an individual's right to personal liberty, personal choice, personal freedom and respect of personal privacy.

The fundamental and somewhat naive intention of IMBRA may well be to safeguard women brought to the U.S.A. by American men, but the heavy-handed and indiscreet way it goes about doing this does not necessarily result in providing the (unrealistic) degree of security it touts for either women or men, it only seems to make a mess out of the whole process and put all concerned in an uncomfortable situation where nothing turns out to be more effective or less problematic for anyone involved.

The Regulation Act, in essence, imposes rules and requirements solely for male U.S.A. citizens who want to use a professional on-line marriage agency (in any form) as a conduit to meeting and subsequently marrying an eligible lady from a foreign country. For the want of a better term, IMBRA somewhat disdainfully refers to any form of on-line organization - whether bogus or not - as an 'International Marriage Broker' (abbreviation: IMB).

In order for the U.S. government to conveniently off-load extra work and the onus onto someone else, namely the on-line agency - those that are part of the reputable minority, that is - IMBRA legislation decrees that it becomes the responsibility of the IMB to collate information and check as to whether a male client is a bad risk to a lady based upon any past criminal record he may have accrued. Any information pertaining to a criminal record of any kind must then be presented to any lady a man is personally interested in.

IMBRA Requirements

There are 4 basic requirements that IMBRA imposes. These are:

1. An IMB is obliged to gather both criminal and family background information pertaining to a U.S.A. citizen client.  This information needs to include notification of any criminal convictions, evidence of domestic abuse, history of divorce, number and age of any children, locations where the U.S.A. citizen has resided since the age of 18, and any prior fiance visa submissions the U.S.A. citizen may have lodged.

2. An IMB is obliged to check the U.S.A. National Sex Offender Public Registry and relevant state public registry regarding a U.S. citizen client.

3. An IMB is obliged to disclose gathered information pertaining to Requirements 1 & 2 to each foreign client lady in whom a U.S.A. citizen client is interested in contacting.

4. An IMB is obliged to obtain the consent of a foreign client lady authorizing the IMB to release her personal information to the U.S.A. citizen client.

Our Responsibility

It is part of our professional charter that the very best interests of both our male and female clients must be served at all times. Respecting a client's right to personal privacy is very important. It is our belief that consenting adults have the right to make their own choices as long as they keep within the guidelines of acceptable and accepted behaviour. Our interpretation of acceptable behaviour may be referenced in our Terms & Conditions document. Basically, negative, destructive, abusive, or harmful behaviour of any kind will not be tolerated and will lead to the removal of such an offender from our web site community.

Our Position

We are in no way connected to any Authoritarian tentacle such as the police, the government, the politicians or the unfettered madness that their inbred, self-destructive worlds wantonly perpetuate. We are here solely as a 'service provider' and do not wish to get caught-up in anyone's political paranoia or imposed political agenda. There is already far too much authoritarian bullying and corruption in the world today without service providers being forced by 'Authority' to add to it. We refuse to be used as an extension of the 'stick-wielding' arm of the 'Powers That Be' anywhere.

However, in order to be able to provide a service that can best serve the interests of our clients, regardless of the country in which they currently reside, we feel it fair to offer a service option that takes into account specific forms of legislation, such as IMBRA. Therefore, for our U.S.A. clients, we offer the option of having a Membership Service Structure that either conforms to the requirements of IMBRA (i.e. IMBRA Compliant Membership) or one that is unrestricted and devoid of any compliance to IMBRA (i.e. Regular Membership as available to everyone everywhere).

Should you select the Regular Membership option, you will not be required to disclose any personal information other than that normally required for General Membership.

Should you select the IMBRA Compliant Membership option, you will be required to disclose all personal information that is in keeping with the requirements as outlined in the IMBRA Requirements Section above.

Those citizens who reside in USA may choose one of two HEAVENLY HEARTS Membership options i.e. Regular Membership or IMBRA Compliant Membership.
